Viking Smackdown is game, created to celebrate Hello Viking's first birthday. By playing Viking Smackdown, you agree you are, by default, wishing Hello Viking a very happy first birthday. Thank you for your kind sentiment.
Viking Smackdown requires some common sense, such as the foresight to hold onto your iPhone or iPod Touch whilst playing the game. Failure to hold onto your iPhone or iiPod Touch is entirely your responsibility. You are playing Viking Smackdown at your own risk.
Please also play responsibly. Others might be near you. Don't injure them.
The Contest runs from July 7 until 5:00pm CST on Friday, August 15. The High Score winner will be announced shortly thereafter. Don't fret–the contest will be closed, but the game will live on. Forever.
Each game is a new game. Play as often as you like. There are ten high scores. You play a game until you lose. If, at that time, your score is better than the tenth lowest high score, you will be prompted to enter your initials and an email address. Your score will then appear in its appropriate place in the rankings. Check the Top Scores tab for current high scores. After the High Score Contest closes, Hello Viking will validate the highest score (#1 position in the rankings) and announce the winner at helloviking.com/yearone. If there is a tie for highest score, we will randomly draw the name of the winner from a Viking helmet.
The winner(s) of the Viking Smackdown High Score Contest will be required to sign and return an affidavit of eligibility, liability release, and publicity release (where legal) within seven (7) days of prize notification. In the event of non-compliance with any of the rules set forth herein, or any prize notification returned as undeliverable, a winner's prize may be forfeited and awarded to an alternative winner. Hello Viking is not responsible for, and shall not be liable for, late, lost, misdirected or unsuccessful efforts to notify the winner. If any winner is a minor in his/her state of residence because he or she is between the ages of 18 and 21, the winner's parent or legal guardian will be required to execute the affidavit and releases. Got that, Viking?
All prizes are awarded "AS IS" (which means, "as is") and without warranty of any kind, expressed or implied (including without limitation, any implied warranty of merchantability or fitness for a particular purpose). No substitution of prizes will be permitted except by Hello Viking, which may substitute a prize of equal or greater value if an advertised prize becomes unavailable. Prizes other than cash and tangible personal property are non-transferable and non-cash prizes may not be redeemed for cash, or, you might just lose your Viking status.
The High Score Contest winner will receive complimentary roundtrip airfare to Minneapolis, MN, all ground transportation, one night's hotel lodging and dinner with Hello Viking in mid-October September 2008. If the contest winner resides in or around Minneapolis, they will receive roundtrip limo service instead of airfare. During their time in Minneapolis, the contest winner will have the opportunity to throw, heft and/or expel a large birthday cake at Tim Brunelle, the CEO of Hello Viking. This event will be filmed and broadcast live on the Internet.
By entering the Contest, you agree to these rules and all eligibility requirements and all decisions of Hello Viking. In addition, if you are a winner of the prize, by accepting the prize you agree that Hello Viking (or any of its affiliates) shall have the right to use your name, address, likeness, photograph, video, prize information, statements and story for all purposes, including online announcements and promotional purposes, without compensation of any kind, except to the extent prohibited by law.
Hello Viking reserves the right, at its sole discretion, to adjust the dates or cancel this promotion for any reason including, but not limited to, technical failure and/or unauthorized intervention. Hello Viking and its affiliates, subsidiaries and legal advisors are not responsible for and shall not be liable for (i) late, lost, stolen, delayed, damaged, misdirected, inaccurate, incorrect, incomplete, or unintelligible entries or entry information, whether due to human error or technical malfunctions; (ii) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties of any kind, including without limitation the inability to access a Hello Viking computer system; (iii) failed, incomplete, interrupted, garbled, or delayed transmissions; (iv) any condition caused by events beyond the control of Hello Viking that may cause the Contest to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind arising in connection with or as a result of the prize, or acceptance, possession, or use of the prize, or from participation in the Contest or (vi) any printing or typographical errors in any materials associated with the Contest. Hello Viking reserves the right, at its sole discretion, to change the rules, upon proper legal notice if required by law.

In the event the administration, security, or proper play of the Contest is compromised in any way, electronically or otherwise, that is beyond the control of Hello Viking, Hello Viking reserves the right to withdraw the transmission of and/or cancel the Contest and award prizes only among entries received prior to the date of withdrawal, or not to award any prizes at all. All entries become the exclusive property of Hello Viking.
By entering the Contest, participants agree to release and hold harmless Hello Viking and its subsidiaries, affiliates, partners, principals, directors, officers, employees and agents (collectively, the "Released Parties") from any liability whatsoever, and waive any and all causes of action, for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Contest or acceptance, possession, or use of any prize (including without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. Each participant further agrees that all rights under Section 1542 of the California Civil Code, and any similar law of any state or territory of the United States, and hereby expressly waived. That section, in pertinent part, provides: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of the executing of the release, which if known by him must materially affect his settlement with the debtor."
Hello Viking reserves the right to disqualify the entry and eligibility of any individual found to be tampering with or abusing the operation of the Contest or the Hello Viking computer system or, to be acting in violation of these rules as solely determined by Hello Viking. By entering the Contest, the entrant agrees that they own all copyrights in the video and/or have express permission from copyright owners and have not violated any copyrighting or laws.

By entering the Contest, entrants herby give and grant to Hello Viking, its affiliates and associated companies, their successors and assigns and any person acting under its permission and authority, the unqualified right, privilege, and permission to reproduce in every manner or form, publish, and circulate videos, films, photographs, voice recordings and transparencies of the entrants and their property arising out of the Contest, including their entries to the Contest. Entrants herby grant, assign, and transfer to Hello Viking all rights and interest therein. Entrants waive any right to inspect, approve, or edit the aforementioned materials or any descriptive or advertising materials used in connection therewith.
Entrants specifically authorize and empower Hello Viking to cause any such videos, films, photographs, voice recordings and transparencies to be copyrighted or in any other manner to be legally registered in the name of Hello Viking.

Entrants, their heirs, executors, administrators and assigns, hereby remise, release, and discharge Hello Viking for and from any and all claims of any kind whatsoever on account of the use of such videos, films, photographs, voice recordings and transparencies, including but not limited to any and all claims for damages for libel, slander, and invasion of the right to privacy.
The Contest and these rules are governed and to be construed under the laws of the State of Minnesota, United States of America.
